Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FXMM Analytics LLC website, dashboard, reports, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

Who We Are

FXMM Analytics LLC ("FXMM," "we," "us," or "our") is a Delaware limited liability company that provides automated market intelligence reports for informational and educational purposes. Our Services are described in further detail in our Risk Disclosure, which is incorporated into these Terms by reference.

Eligibility

You must be at least 18 years old, or the age of majority in your country of residence if that is higher, to use our Services. By using our Services, you represent that you meet this requirement and that your use complies with all laws applicable to you.

Our Services are offered only to individual retail traders for their own personal use. By subscribing, you represent that you are an individual (natural person) who uses our reports solely to manage your own assets, and not the assets of any third party in any capacity; that you are not a member of, and do not hold or lease a membership in, any exchange; that you are not registered or qualified as a professional trader or investment adviser with any stock, commodities or futures exchange or contract market, or with any financial regulatory authority; and that you are not acting on behalf of an institution that engages in brokerage, banking, investment or financial activities. If this changes, you must notify us and stop using the Services.

Account Registration

To access certain features of our Services, you may be required to create an account. You agree to provide accurate and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Each subscription is for individual use. Account sharing is not permitted.

Privacy

Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, and is incorporated into these Terms by reference.

Subscription, Billing & Free Trial

Certain Services are offered on a subscription basis, billed monthly or, where offered, for longer periods (such as quarterly, semiannual, or annual), and may include a free trial. Trial conditions may vary and may require a valid payment method or a fee; the conditions that apply will be shown before you start. Full details regarding pricing, billing cycles, special rates, trials, cancellation, and refunds are set out in our Billing & Refunds Policy, which is incorporated into these Terms by reference. You may cancel your subscription at any time through your account settings.

We may also offer discount codes and a subscriber referral program. Their conditions, including eligibility, credits and limits, are described in our Billing & Refunds Policy and are shown at checkout or in your account.

Acceptable Use

You agree not to: (a) use our Services for any unlawful purpose; (b) attempt to gain unauthorized access to our systems or another user's account; (c) reproduce, resell, or redistribute our reports or any part of our Services without our prior written consent; (d) use automated means to scrape, copy, or extract content from our Services; or (e) misrepresent your affiliation with FXMM Analytics LLC.

Intellectual Property

All content, reports, methodology, design, trademarks, and materials made available through our Services are the property of FXMM Analytics LLC or its licensors and are protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to access and use our reports for your own personal or internal use only.

Personal Use & Data Licensing Restrictions

Our reports are built in part on data licensed to FXMM Analytics LLC under commercial agreements, including CME Group market data used under license, that require us to restrict redistribution of that data. Accordingly, your subscription and access to our reports are for your own personal use only. Each subscription is for one individual. You may not share your account or access credentials, and you may not share, forward, republish, or otherwise redistribute any report or the information it contains to any third party, whether or not for compensation. Any account found to be sharing access or redistributing reports may be suspended or terminated.

CME GROUP MARKET DATA IS USED UNDER LICENSE AS A SOURCE OF INFORMATION FOR CERTAIN FXMM ANALYTICS LLC PRODUCTS. CME GROUP HAS NO OTHER CONNECTION TO FXMM ANALYTICS LLC PRODUCTS AND SERVICES AND DOES NOT SPONSOR, ENDORSE, RECOMMEND OR PROMOTE ANY FXMM ANALYTICS LLC PRODUCTS OR SERVICES. CME GROUP HAS NO OBLIGATION OR LIABILITY IN CONNECTION WITH THE FXMM ANALYTICS LLC PRODUCTS AND SERVICES. CME GROUP DOES NOT GUARANTEE THE ACCURACY AND/OR THE COMPLETENESS OF ANY MARKET DATA LICENSED TO FXMM ANALYTICS LLC AND SHALL NOT HAVE ANY LIABILITY FOR ANY ERRORS, OMISSIONS, OR INTERRUPTIONS THEREIN. THERE ARE NO THIRD-PARTY BENEFICIARIES OF ANY AGREEMENTS OR ARRANGEMENTS BETWEEN CME GROUP AND FXMM ANALYTICS LLC.

Feedback, Reviews & Testimonials

If you provide us with any feedback, suggestions, or ideas regarding our Services, you grant FXMM Analytics LLC a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, incorporate, and act upon such feedback without any obligation or compensation to you.

If you submit a review, rating, or testimonial about our Services, through our website, by email, or on a public platform, you grant FXMM Analytics LLC a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it, together with your first name, initials, or public username, on our website, in our marketing materials, and on social media. We will not edit a review in a way that changes its meaning, and you may ask us at any time to stop using your review in new materials.

Third-Party Links & Services

Our Services may reference or link to third-party brokers, tools, or platforms, including through partners and affiliates. FXMM Analytics LLC is not responsible for the performance, availability, security, or quality of any third-party product or service, and any issues arising from your use of a third party's product or service are solely between you and that third party.

Partner Conduct

Brokers, affiliates, promoters, and other partners working with FXMM Analytics LLC sign their own agreement with us, which defines what they are and are not authorized to represent. If a partner makes any statement, promise, guarantee, or representation that falls outside of what is authorized under their agreement with us, FXMM Analytics LLC is not responsible or liable for such conduct. We encourage users to notify us of any such conduct through our Contact page.

Changes to or Discontinuation of the Services

We may update, modify, or remove features, report content, coverage, or data sources over time, provided the core Services remain substantially the same. We may also discontinue the Services, in whole or in part, with at least 30 days' notice where reasonably possible.

Some of the data our Services rely on is provided under third-party licenses that may change or end. If this materially affects the Services, any prepaid amounts will be handled as described in our Billing & Refunds Policy.

Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our Services will be uninterrupted, timely, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, FXMM Analytics LLC, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or trading losses, arising from your use of our Services, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, the total liability of FXMM Analytics LLC, its officers, employees, and affiliates for any claim arising out of or relating to these Terms or our Services shall not exceed the total amount you paid to FXMM Analytics LLC for the Services in the twelve (12) months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless FXMM Analytics LLC, its officers, employees, and affiliates from any claims, losses, damages, liabilities, or expenses (including reasonable attorneys' fees) arising out of your use of our Services, your trading decisions, or your violation of these Terms.

Export Control & Prohibited Persons

You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a "terrorist supporting" country, and that you are not listed on any U.S. government list of prohibited or restricted parties, including the U.S. Treasury's Specially Designated Nationals list.

Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, FXMM Analytics LLC, or third parties.

If we suspend or terminate your account for a violation of these Terms, including sharing your account or redistributing our reports, no refund will be issued for any remaining prepaid period.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. If you have any concern or dispute, you agree to first contact us and attempt to resolve the matter informally. If a dispute cannot be resolved informally within 30 days, any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual action in small claims court. The arbitration shall take place in Miami-Dade County, Florida, or by video conference or written submissions where the AAA rules allow, and shall be conducted by a single arbitrator. Judgment on the arbitration award may be entered in any court having jurisdiction.

You and FXMM Analytics LLC agree that any arbitration shall be conducted on an individual basis only, and not as a class, consolidated, or representative action.

You may opt out of this arbitration agreement by sending an email to support@fxmarketmap.com within 30 days after you first accept these Terms, stating your name, the email address of your account, and that you opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida. Any change to this section will not apply to a dispute of which we had received notice before the change took effect.

Force Majeure

FXMM Analytics LLC is not responsible for any delay or failure to provide the Services caused by events beyond our reasonable control, including outages or failures of data providers, hosting or internet services, exchange or market disruptions, changes in law, natural disasters, or acts of government.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver of any breach of these Terms shall constitute a waiver of any subsequent breach.

Assignment

You may not transfer your account or your rights under these Terms to anyone else. FXMM Analytics LLC may assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, or sale of assets.

Electronic Communications

By creating an account, you agree to receive communications from us electronically, including by email, dashboard notifications, and Telegram if you enable it. These communications satisfy any legal requirement that a communication be in writing. Legal notices, including notices of suspension, termination, or a dispute, may be sent to the email address associated with your account and are considered received when sent. You are responsible for keeping that email address up to date.

Entire Agreement & Survival

These Terms, together with our Privacy Policy, Risk Disclosure, and Billing & Refunds Policy, are the entire agreement between you and FXMM Analytics LLC regarding the Services. Sections that by their nature should continue after your account ends, including those on intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive termination.

Translation & Language Precedence

These Terms may be made available to you in both English and Spanish. In the event of any conflict or inconsistency between the two versions, the English version shall prevail.

Changes to These Terms

FXMM Analytics LLC may update these Terms from time to time. If we make a material change, we will notify active subscribers by email at least 15 days before it takes effect, and we will show the updated date on this page. Continued use of our Services after the change takes effect constitutes your acceptance of the revised version.
